I'm glad you have added your experience here, and I am sorry you have had problems with idiots! Call the sheriff and charge them with trespass. Maybe then they will get a clue.[/quote]
They're not all idiots....some are, the rest (and most) are amateur attorneys who know they know the law and are prepared to inform the landowner's what their rights are on the landowner's property (their interpretation anyway). Those are my favorites. I had a guy stop me one time going into my own field and he informed me that I better not be going in there......he could because he and the landowner were buddies and he was the only one who had permission. How can you not laugh at crap like that?
Call the Sheriff? Now that's funny. If you're a real jerk on my property without my permission you're in for a real education. I've walked guys to the road and made them leave their trucks or 4 wheelers right where I found them.....on my property. There's been some unhappy people. Some bring the Sheriff back with them.
You guys are right.....this is hard to separate the waterway rights from the trespass issues.....one seems to lead to the other for those who don't know or understand the law. Either side can be guilty. I try to follow the law.....it is the law. I myself have had to crawl through some nasty willow outcroppings hanging over the river through someone else's property trying not to destroy my gear to get to a good spot, without violating the property owners rights, so I know its a pain. .
Now....if you stop and ask permission and mention fishing you will have my undivided attention and a good conversation. I could also tell you some seemingly unbelievable stories about some people's antics, attitudes and down right gall related to this subject. I can also tell you about a lot of genuinely great people who are just looking for a great fishing experience. I believe you guys fit in the later category.
