Riverdog, I have enjoyed our very civil discussions on this matter in the past.
This is a very touchy subject that does seem to get people on both sides railed up.
The points I am bringing up are not meant to slander or defame anybody here.
I only point out what the defendants in this case will bring to bear in court and in the legislature.
Like I have said before the whole case rests on the definition of navigable.
As a matter of fact I believe you and I have agreed on that point in the past.
Just type in "States definition of navigable". It would take you 2 days to read all the different definitions, and legaleez that goes along with it.
One state I can't remember which says you have to be able to float a boat with 2 men and a goat on board. If not the land owner has the right to keep you off.
I think you and I have agreed, that when all is said and done There will be a hand full of waters in Utah opened up due to compromise on both sides.
And by the way, the only people who lived in Utah before my family came to Utah were the Indians. So no we will not be going anywhere anytime soon.
But thanks for the advice!
