Mojorising, I would say the state of Idaho has a pretty clear definition. From page 44 in the Idaho Fishing Rules book...

It unambiguously states "from the seat down in the water" [#4040ff]Once again referring to the seat of the tube[/#4040ff]-[#4040ff]you're sitting in a tube. Your legs are in the water. It's very simple, but I guess I can see where some could get
